The probate court will schedule a hearing to hear evidence as to whether the individual is incapacitated and/or incapable of making financial decisions for him or herself. These appointments can either be voluntary or involuntary depending on the situation. If the person in question is found to be incapacitated, the probate court may grant either a general or limited conservatorship, depending on the level of need. If the individual is mostly able to take care of her or himself, but needs assistance with finances, the probate court my grant a limited conservatorship where someone will help the individual only in areas deemed necessary. |
